Subject: Notification of Contractor Disqualification from Bidding on University of California Construction Work
Dear {CONTRACTOR OR SUBCONTRACTOR NAME}:
This letter is to serve notice to your firm that {CONTRACTOR OR SUBCONTRACTOR NAME} has been determined not to be a "responsible" bidder for University of California (University) construction projects. This determination is based specifically on the following examples of your performance that are not responsible: {LIST THE SPECIFIC EXAMPLES USED AS THE BASIS FOR THE DETERMINATION}. Your firm will not be eligible to bid on any University construction project {STATE PERIOD, FOR EXAMPLE: for three years from the date of this determination OR indefinitely (AS APPLICABLE AND AS SPECIFIED IN UNIVERSITY POLICY)}.
Your firm will have ten (10) calendar days from receipt of this letter within which to make a written appeal of the determination that your firm's performance is not responsible. The appeal must be made to: Chair, Construction Review Board, University of California, Office of the President, 1111 Franklin Street, 6th Floor, Oakland, CA 94607, with a concurrent copy sent to me at {ADDRESS}. Failure to submit such written appeal within the ten-calendar-day period shall constitute your agreement with the determination. If a written appeal is submitted as required, the University will hold a hearing on the determination and your objections. The hearing officer will give you notice in writing at least five (5) calendar days before the scheduled date of the hearing on the determination that your firm's performance is not responsible.
