Nancy M. Ware
Before joining the Laboratory in 1992, Nancy was a partner of the Landels, Ripley & Diamond law firm in San Francisco. Nancy's past law firm experience includes commercial, environmental, employment, and personal injury defense litigation including regular appearances in state and federal court and three trials. She also handled environmental law compliance counseling; defense of clients under federal and state environmental laws in response to government agency investigations, notices of violation (NOVs) complaints, and cost recovery actions; and advice to developers of Bay Area hotel and commercial properties on purchase and cleanup of contaminated sites.
At the Laboratory, Nancy's practice has included strategic guidance to management and project teams and extensive advice and review on California Environmental Quality Act (CEQA) and/or National Environmental Policy Act (NEPA) environmental impact assessments for numerous Laboratory development projects as well as the 2007 Long Range Development Plan. She also has advised on complex environmental, health, and safety issues under federal, state, and local laws and defended the Laboratory in response to investigations, NOVs, cost recovery actions, and complaints under such laws.
Nancy has defended the Laboratory against citizen group lawsuits, including the challenge to the 2007 Long Range Development Plan EIR resulting in a published Court of Appeal opinion upholding the EIR in full. Nancy also has advised on numerous issues under non-EHS laws including the export control laws, the Americans with Disabilities Act, and the California Fair Employment and Housing Act; guided responses to subpoenas and records requests under FOIA, the California Public Records Act, the EEOICPA, HIPPA, and other federal and state laws; and negotiated and advised on agreements and MOUs on site access, equipment donation, procurement, and collaboration in support of the Laboratory's scientific research mission.
Nancy is a graduate of Yale University (B.S., Biology) and the UCLA School of Law.
